yep i think it's fair. the guy committed a crime.
his actions damaged another persons (usa gov) property.
the fact he left messages saying they should tighten their security is irrelevant.
if he had been on your machine and it was left inoperable or parts of it left unaccessible wouldn't you want some kind of compensation. if they caught the guy.
lets just say he'd wiped all the pics of yur kids of the pc and you had no way of getting them back, at the end of the day he hacked someone elses machines. to say they should have had better security or used passwords is a crock of of shit.
might as well blame the shop keeper when his merchandise gets stolen of the houseowners when his house gets burgled. if it was a crime that like file sharing (sometimes without copyright permissions) which have more to do with social conscience and morality then i'd say a resounding no. as it is hacking is a crime. a solid crime not only against a machine but against a person and as such the person should face charges. if an extradition treaty exists then t should be allowed to be enforced.
all that said. the kids ill (we presume) so maybe the courts has a case to dispense leniency. if it's proved in court that the person was just doing it because he could, that he never meant to do any damage or steal any info. (which he was, he clearly states he was searching for secret docs re ufo's) then slap his wrist and give a small fine. if on the other hand it was a searching hack to gain info. give a him a big fine and if he has no cahs give the fucker some jail time. not too much but a bit at least. jmo
